Please read these terms carefully before using The Fair Price platform. By accessing our services, you agree to be bound by the following terms and conditions.

Welcome to The Fair Price ("Platform", "we", "us", or "our"), a real estate listing and advisory platform operated by The Fair Price Realty Pvt. Ltd., registered under the Companies Act 2013, with its principal office at DLF Cyber City, Gurugram, Haryana — 122002, India.

By accessing or using our website at www.thefairprice.com, mobile applications, or any related services (collectively, the "Services"), you acknowledge that you have read, understood, and agree to be legally bound by these Terms and Conditions ("Terms") and our Privacy Policy.

Important Notice

If you do not agree with any part of these Terms, you must immediately discontinue use of our Platform and Services. Continued use constitutes acceptance of any changes to these Terms.

These Terms apply to all visitors, users, registered members, property listers, real estate agents, developers, and any other persons who access or use the Platform.


For the purposes of these Terms and Conditions, the following definitions shall apply:

"Platform"Refers to The Fair Price website (www.thefairprice.com), mobile applications, and all related digital services owned and operated by The Fair Price Realty Pvt. Ltd.
"User" / "You"Any individual or entity accessing the Platform, including buyers, sellers, renters, landlords, real estate agents, developers, and general visitors.
"Listing"Any property advertisement, description, image, pricing, or related information submitted to or published on the Platform.
"Lister"Any registered user — individual, agency, or developer — who submits a property Listing on the Platform.
"Services"All features, tools, content, and functionalities offered by the Platform including search, enquiries, advisory, lead generation, and listing management.
"RERA"The Real Estate (Regulation and Development) Act, 2016, and all rules and regulations made thereunder.
"Confidential Information"Any non-public, proprietary information disclosed through the Platform including user data, transaction details, and business data.

By using our Platform, you agree to abide by the following usage rules. You may:

  • Browse property listings, market insights, and real estate guides for personal, non-commercial use
  • Submit enquiries and contact listers for genuine property purchase, sale, or rental purposes
  • Register a user account and manage your property interests, saved searches and preferences
  • List properties for sale or rent subject to registration, verification, and applicable fees
  • Access blog content, reports, and tools provided for informational and educational purposes

You must not:

  • Use automated bots, scrapers, crawlers, or any technology to extract data from the Platform without prior written consent
  • Post false, misleading, fraudulent, or duplicate property listings or any content that misrepresents a property
  • Solicit other users for business outside the Platform or use contact information obtained through the Platform for spam or unsolicited communications
  • Attempt to gain unauthorised access to any part of the Platform, user accounts, databases, or server infrastructure
  • Upload or transmit viruses, malware, or any code that may compromise the Platform's integrity or security
  • Reproduce, redistribute, or commercially exploit any content from the Platform without explicit written permission
Platform Integrity

Violation of these usage terms may result in immediate suspension or permanent termination of your account, removal of your listings, and potential legal action under applicable Indian law.


The Fair Price provides a platform for Listers to advertise properties to potential buyers and renters. We act as an intermediary and not as a party to any real estate transaction.

  • Lister Responsibility: All Listers are solely responsible for the accuracy, completeness, legality, and currency of their listings. This includes property dimensions, pricing, amenities, legal encumbrances, RERA registration status, and possession timelines.
  • RERA Compliance: Properties covered under the Real Estate (Regulation and Development) Act, 2016 must be RERA registered before listing on our Platform. Listers must provide a valid RERA registration number, which will be displayed on the listing.
  • Verification: While we endeavour to verify listings for quality and authenticity, we do not guarantee the accuracy or completeness of any listing. Users are advised to conduct their own due diligence before entering into any property transaction.
  • Removal Rights: We reserve the right to remove, edit, or suspend any listing at our sole discretion if it is found to be inaccurate, misleading, illegal, or in violation of these Terms — without prior notice to the Lister.
Buyer Advisory

We strongly recommend all buyers and renters independently verify RERA registration at haryanarера.gov.in, verify title documents through a qualified legal counsel, and physically inspect the property before making any payment or signing any agreement.


Certain features of the Platform require you to create a registered account. By registering, you agree to the following:

  • You will provide accurate, current, and complete information during registration and keep it updated at all times.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities occurring under your account.
  • You will immediately notify us at legal@thefairprice.com of any unauthorised use of your account or any other security breach.
  • You will not share your account, transfer it to another person, or create multiple accounts for the same individual or organisation.
  • We reserve the right to refuse registration, suspend, or permanently terminate any account at our sole discretion, including for violation of these Terms or applicable law.
  • Upon termination of your account, your right to use the Platform ceases immediately. We may retain your account data as required by applicable law or for legitimate business purposes.

The Fair Price offers both free and paid tiers of service. Paid services may include premium listing packages, featured placements, lead generation tools, and advisory services. By subscribing to any paid service, you agree to the following:

  • Pricing: All fees are displayed in Indian Rupees (₹) and are inclusive of applicable GST at the prevailing rate unless otherwise stated.
  • Payment: Payments are processed via secure third-party payment gateways. We do not store your card or payment credentials on our servers.
  • Billing Cycle: Subscription-based services are billed in advance on a monthly or annual basis as selected at the time of purchase.
  • Refunds: Fees paid for listing packages are non-refundable once the listing has been published. Refunds for unused subscription periods may be considered on a case-by-case basis. Please refer to our Refund Policy for details.
  • Price Changes: We reserve the right to revise our pricing at any time. Changes will be communicated with a minimum of 30 days' notice via email to registered users.
  • Taxes: You are responsible for all applicable taxes, levies, or duties imposed by relevant government authorities in connection with your use of our paid services.

All content on the Platform — including but not limited to the website design, interface, layout, graphics, logos, icons, text, software, code, databases, blog articles, market reports, and tools — is the exclusive intellectual property of The Fair Price Realty Pvt. Ltd. or its licensors, and is protected under the Copyright Act, 1957 and applicable Indian and international intellectual property laws.

  • You may not copy, reproduce, republish, upload, post, transmit, or distribute any content from the Platform without our prior express written permission.
  • Listers retain ownership of the property content they submit but grant The Fair Price a non-exclusive, royalty-free, worldwide licence to display, promote, and distribute that content through our Platform and marketing channels.
  • The Fair Price name, logo, and taglines are registered trademarks. Use of our trademarks without authorisation is strictly prohibited.
  • Any feedback, suggestions, or ideas you provide to us may be used by The Fair Price without obligation or compensation to you.

The Platform and all content, information, and services are provided on an "AS IS" and "AS AVAILABLE" basis, without any warranties of any kind, either express or implied.

  • No Warranty: We do not warrant that the Platform will be error-free, uninterrupted, secure, or free of viruses or other harmful components.
  • No Investment Advice: Information on the Platform, including market trends, price estimates, and investment commentary, is for general informational purposes only and does not constitute financial, legal, or investment advice. Always consult a qualified professional before making any property investment decision.
  • Third-Party Content: We are not responsible for the accuracy of any third-party content, links, advertisements, or listings on the Platform.
  • Property Transactions: The Fair Price is not a party to any property transaction and does not represent either buyer or seller in any transaction facilitated through the Platform. All transactions are solely between the parties involved.

To the maximum extent permitted by applicable law, The Fair Price Realty Pvt. Ltd., its directors, officers, employees, agents, and partners shall not be liable for any:

  • Direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of or inability to use the Platform or Services
  • Loss or corruption of data, loss of profits, goodwill, or business opportunities, even if advised of the possibility of such damages
  • Losses arising from reliance on any content, listing information, or advice obtained through the Platform
  • Losses arising from any property transaction, dispute, fraud, or misrepresentation by any third party including Listers, agents, or developers
Aggregate Liability Cap

In any case, our maximum aggregate liability to you for any claim arising out of or relating to the use of our paid Services shall not exceed the total amount paid by you to The Fair Price in the three (3) months immediately preceding the date of the claim.


Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to our collection, use, storage, and disclosure of your personal information as described in the Privacy Policy.

  • We collect personal information including name, contact details, search preferences, and usage data to provide and improve our Services.
  • We do not sell your personal data to third parties. We may share data with trusted service providers, regulatory authorities, or as required by law.
  • You may request access to, correction of, or deletion of your personal data by contacting us at privacy@thefairprice.com.
  • By submitting an enquiry or registering an account, you consent to being contacted by The Fair Price and relevant property Listers via phone, email, SMS, or WhatsApp.

Either party may terminate this agreement at any time. You may delete your account through your account settings or by contacting us. We may terminate or suspend your access immediately, without prior notice, if:

  • You breach any of these Terms or our usage policies
  • You engage in fraudulent, abusive, or illegal activity on the Platform
  • We are required to do so by law or a regulatory authority
  • We discontinue the Platform or any specific Service

Upon termination, your right to access and use the Platform ceases immediately. Sections 7 (Intellectual Property), 8 (Disclaimers), 9 (Limitation of Liability), and 12 (Governing Law) shall survive termination.


These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

  • Jurisdiction: Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Gurugram, Haryana, India.
  • Arbitration: Any dispute, controversy, or claim arising out of or in connection with these Terms that cannot be resolved amicably within 30 days shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted by a sole arbitrator mutually appointed by both parties, seated in Gurugram, in the English language.
  • Consumer Disputes: Nothing in these Terms limits your rights as a consumer under the Consumer Protection Act, 2019 or any other applicable consumer protection legislation.

We reserve the right to modify these Terms at any time in our sole discretion. When we make material changes, we will:

  • Update the "Last Updated" date at the top of this page
  • Send a notification to registered users via email and/or in-platform notification
  • Post a prominent notice on the Platform homepage for at least 14 days

Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Platform immediately.
