The Fair Price Realty Pvt. Ltd. ("The Fair Price", "we", "us", "our") is a real estate technology company incorporated under the Companies Act 2013, with its registered office at DLF Cyber City, Gurugram, Haryana — 122002, India. CIN: U70200HR2018PTC073XXX.

We operate the website www.thefairprice.com, mobile applications, and associated digital services (collectively the "Platform") — a marketplace and advisory platform for buying, selling, and renting residential and commercial real estate across India.

For the purposes of this Privacy Policy, The Fair Price is the Data Fiduciary (controller) of your personal data as defined under the Digital Personal Data Protection Act, 2023 ("DPDP Act").

Scope of This Policy

This Policy applies to all personal data collected from users of our Platform — including property buyers, sellers, landlords, tenants, real estate agents, developers, and visitors. It does not apply to data collected by third-party websites linked from our Platform.

We collect different categories of personal data depending on how you interact with our Platform:

Email address, mobile number, WhatsApp number, residential/business address
Property Data
Property listings, RERA numbers, ownership documents, pricing, photos, floor plans
Usage & Preference Data
Search queries, saved properties, enquiries sent, pages visited, click behaviour
Financial Data
Subscription plan details, payment history, billing address (we do NOT store card numbers)
Technical Data
IP address, browser type, device model, OS version, session duration, referral source
Sensitive Personal Data

We do not intentionally collect sensitive personal data (health, biometric, religion, caste, financial credentials) unless explicitly required for a specific service and with your separate written consent. If you voluntarily share such information (e.g. in a support message), it will be handled with heightened protection.

How We Collect Your Data

We collect personal data through the following means:

  • Direct Interactions: When you register an account, submit a property listing, fill an enquiry form, subscribe to our newsletter, apply for home loan assistance, or contact our support team.
  • Automated Technologies: When you browse our Platform, we automatically collect technical and usage data via cookies, web beacons, pixels, and server log files.
  • Third-Party Sources: We may receive data about you from data partners, social media platforms (when you connect your account), Google/Facebook login services, and public RERA registries.
  • Referrals: If another user or agent refers you to our Platform and provides your contact details with your knowledge and consent.
  • Phone & WhatsApp Interactions: When you call our helpline or initiate contact via WhatsApp, calls and chats may be recorded for quality assurance and training purposes.

Why We Use Your Data

We use your personal data for the following purposes:

  • Platform Operation: To create and manage your account, display property listings, process enquiries, and deliver the core features of the Platform.
  • Communication: To send you property alerts, transaction notifications, enquiry updates, and respond to your support requests via email, SMS, or WhatsApp.
  • Personalisation: To understand your property preferences and deliver personalised search results, recommendations, and content tailored to your interests.
  • Marketing: To send promotional content about new projects, market reports, and platform updates. You can opt out of marketing communications at any time.
  • Analytics & Improvement: To analyse user behaviour, measure platform performance, identify bugs, and improve the overall user experience.
  • Legal Compliance: To comply with applicable Indian laws including RERA, GST, FEMA (for NRI transactions), DPDP Act, and court/regulatory orders.
  • Fraud Prevention & Security: To detect, prevent, and investigate fraudulent listings, identity fraud, and platform abuse.
  • Home Loan Assistance: If you use our loan advisory service, your data will be shared with lending partners with your explicit consent to facilitate loan applications.

Section 05

Legal Basis for Processing

Under the Digital Personal Data Protection Act, 2023 (DPDP Act) and the Information Technology (Reasonable Security Practices) Rules, 2011, we process your personal data on the following lawful bases:

  • Consent: For marketing communications, cookie-based tracking, sharing data with loan partners, and processing sensitive personal data — we rely on your free, specific, informed, and unambiguous consent.
  • Contractual Necessity: To fulfil our obligations to you under a contract — such as account registration, listing management, or paid subscription services.
  • Legitimate Interests: For fraud prevention, security monitoring, platform analytics, and improving our services — where our interests do not override your fundamental rights.
  • Legal Obligation: Where processing is required to comply with applicable law, regulatory requirements, or court orders.
Consent Withdrawal

Where we rely on consent as the legal basis, you have the right to withdraw your consent at any time without affecting the lawfulness of processing done before withdrawal. To withdraw consent, email privacy@thefairprice.com or manage preferences in your account settings.


Section 06

Data Sharing & Disclosure

We do not sell, rent, or trade your personal data. We may share your data only in the following limited circumstances:

  • Property Listers & Agents: When you submit a property enquiry, your name, phone number, and email are shared with the relevant lister/agent to facilitate a response. This sharing is inherent to the purpose of the Platform.
  • Service Providers: Trusted third-party vendors who assist in operating the Platform — including cloud hosting (AWS/Azure), payment processors, SMS/email delivery, analytics (Google Analytics), and customer support tools — under strict data processing agreements.
  • Home Loan Partners: With your explicit consent, your data may be shared with NBFC partners and banks for processing home loan enquiries.
  • Legal & Regulatory Authorities: When required by law, court order, RERA authority, Income Tax Department, or other government/regulatory bodies.
  • Business Transfers: In the event of a merger, acquisition, or sale of all or part of our business, your data may be transferred to the acquiring entity, with notice provided to you.
  • With Your Consent: In any other circumstances with your prior explicit consent.
International Data Transfers

We primarily store and process data within India. If any data is transferred internationally (e.g. via cloud infrastructure), we ensure that adequate safeguards — including contractual clauses and adequacy decisions — are in place as required under applicable law.


Section 07

Data Retention

We retain your personal data only for as long as necessary to fulfil the purposes for which it was collected, comply with legal obligations, resolve disputes, and enforce our agreements. The following general retention periods apply:

After the retention period expires, data is securely deleted or anonymised. You may request early deletion of your data subject to legal hold obligations.

Data Security

We implement robust technical and organisational security measures to protect your personal data against unauthorised access, accidental loss, disclosure, alteration, or destruction.

  • Encryption: All data in transit is encrypted using TLS 1.3 (HTTPS). Data at rest is encrypted using AES-256 standard.
  • Access Controls: Personal data is accessible only to authorised personnel on a strict need-to-know basis. All access is logged and audited.
  • Infrastructure Security: Our servers are hosted on ISO 27001-certified cloud infrastructure with firewalls, DDoS protection, and intrusion detection systems.
  • Payment Security: Payment processing is handled exclusively by PCI-DSS compliant payment gateway providers. We never store card numbers or CVV codes.
  • Regular Audits: We conduct periodic security vulnerability assessments and penetration testing.
  • Breach Response: In the event of a personal data breach, we will notify affected users and the Data Protection Board of India within 72 hours as required under the DPDP Act 2023.
User Responsibility

While we take every precaution to protect your data, no internet transmission is 100% secure. You are responsible for keeping your account password confidential and for logging out after each session on shared devices. Report any suspicious activity immediately to security@thefairprice.com.

Cookies & Tracking Technologies

We use cookies and similar technologies (pixels, web beacons, local storage) to enhance your experience, remember your preferences, and understand how you interact with our Platform.

You can manage cookie preferences via the Cookie Settings panel (accessible from the footer). You can also disable cookies via your browser settings, though this may affect Platform functionality.

Section 11

Children's Privacy

The Fair Price Platform is intended for use by individuals who are 18 years of age or older. We do not knowingly collect personal data from children under the age of 18.

  • If you are under 18, you must not use the Platform or submit any personal information.
  • If we become aware that we have inadvertently collected data from a child under 18, we will promptly delete it from our systems.
  • Parents or guardians who believe their child has submitted personal data to our Platform should contact us immediately at privacy@thefairprice.com.

Section 12

Third-Party Links & Integrations

The Platform may contain links to third-party websites, RERA portals, news portals, bank websites, and other external services. This Privacy Policy does not apply to those third-party sites.

  • We are not responsible for the privacy practices, content, or security of any third-party websites linked from our Platform.
  • We recommend reviewing the privacy policy of any third-party website before submitting personal information to them.
  • Third-party integrations such as Google Maps, YouTube embeds, and social login services are governed by their respective privacy policies (Google Privacy Policy, Meta Privacy Policy).
  • Our Platform may include property developer microsite links. Data submitted directly to developers is governed by their own privacy policies.

Section 13

Changes to This Policy

We may update this Privacy Policy periodically to reflect changes in our data practices, new services, or applicable law. When material changes are made, we will:

  • Update the "Last Updated" date at the top of this page
  • Send an email notification to all registered users at their registered email address
  • Display a prominent notice on the Platform homepage for a minimum of 14 days
  • For significant changes affecting your rights, seek fresh consent where required by the DPDP Act 2023

Your continued use of the Platform after the effective date of the revised Policy constitutes your acceptance of the changes. We encourage you to periodically review this page to stay informed.
